By accessing or using the Nexus POS Platform (“Nexus”), including the NexusMobile application and the NexusPOS API, you agree to be bound by these Terms of Service. Nexus is operated by TruVision Technologies Pty Ltd (“TruVision”).
Nexus is an enterprise point-of-sale and restaurant operations platform. It provides POS transaction processing, kitchen display management, digital menuboard scheduling, device fleet management, workforce rostering, loyalty program management, and related operational services to hospitality businesses.
Access to Nexus is provisioned by your employer (the tenant administrator). You are responsible for maintaining the confidentiality of your login credentials. You must not share your credentials with any other person.
You may use Nexus only for its intended purpose — operating your employer's hospitality business. You must not:
Nexus facilitates EFTPOS payment processing through third-party providers. TruVision does not process, store, or have access to cardholder data. All payment processing is subject to the terms of the relevant payment provider.
All business data entered into Nexus (orders, transactions, employee records, menu configurations) belongs to the tenant (your employer). TruVision acts as a data processor on behalf of the tenant. Upon subscription cancellation, tenant data is available for export during a 90-day wind-down period.
Nexus is designed to operate offline-first — point-of-sale and kitchen operations continue during internet outages. TruVision targets 99.9% uptime for cloud services but does not guarantee uninterrupted availability.
Nexus, including its software, documentation, branding, and user interface designs, is the intellectual property of TruVision Technologies Pty Ltd. Your subscription grants a non-exclusive, non-transferable licence to use Nexus for the duration of the subscription.
To the maximum extent permitted by Australian law, TruVision's liability for any claim arising from the use of Nexus is limited to the subscription fees paid by the tenant in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.
These Terms are governed by the laws of the State of Victoria, Australia. Any disputes will be resolved in the courts of Victoria.
TruVision may update these Terms from time to time. Tenant administrators will be notified of material changes via the Nexus dashboard. Continued use after notification constitutes acceptance.
